Why It Was Scrapped

On Thursday, the Department of Transportation under President Donald Trump announced it was abandoning the rule, calling the move “consistent with Department and administration priorities.”

The Trump administration has repeatedly sought to roll back federal regulations it deems wasteful or overly burdensome.

Industry group Airlines for America (representing United, Delta, and Southwest) welcomed the decision, saying:

“We are encouraged by this Department of Transportation reviewing unnecessary and burdensome regulations that exceed its authority and don’t solve issues important to our customers.”


Airline Opposition

Carriers strongly opposed the proposal:

  • Spirit Airlines, in a public filing, warned that such rules would drive up operating costs and raise ticket prices.
  • The airline argued: “If every time a flight has to be cancelled due to, say, an aircraft maintenance issue, airlines were required to pay each affected passenger $300 plus hotel and meals, there would be a perverse incentive to cancel flights preemptively at any hint of trouble.”

Spirit itself filed for Chapter 11 bankruptcy last week for the second time in a year and announced plans to suspend service in about a dozen U.S. cities.


Current Situation for Passengers

At present, U.S. airlines do provide some assistance for cancellations and delays, but:

  • Passengers usually have to ask directly at the airport
  • Airline promises are not backed by federal law
