New DOT Rules as of October 2024

In October 2024, the Department of Transportation introduced new rules requiring any airline operating flights to, from, or within the US to automatically issue refunds when flights are canceled or significantly changed. These new federal guidelines clearly define what qualifies as a “significant change,” removing ambiguity for both passengers and airlines.


How the Automatic Refund Rules Work

Passengers are entitled to an automatic cash refund—returned to the original form of payment—for any unused part of their ticket when:

  • A flight is canceled
  • A flight undergoes a significant schedule change

To receive the refund, the traveler must:

  • Refuse the modified flight option
  • Decline rebooking on an alternate flight
  • Reject other compensation options such as vouchers

Refunds also include:

  • Fees paid for services not received (such as seat selection, Wi-Fi, or early boarding)
  • Checked bag fees if the bags are delayed beyond the defined timeline

These regulations apply regardless of the cause of the cancellation or delay.


Why Travelers Need to Know Their Rights

Although these rules are a major win for US consumers, many travelers remain unaware of them. As a result, passengers may not push back when an airline attempts to offer vouchers instead of the legally required refund.

This lack of awareness can be costly. Beyond the inconvenience of being stranded or losing valuable vacation time, passengers may miss out on money they are legally owed.


These Refund Rules Still Stand

It’s important to note that these federal refund protections remain active even as the DOT has rolled back other consumer-friendly proposals. In November 2025, the Trump administration’s DOT withdrew a proposed rule that would have:

  • Required cash compensation for significantly delayed flights
  • Guaranteed hotel accommodations or meal vouchers during extended delays

That withdrawn proposal is not connected to the refund rules for cancellations, significant changes, or unfulfilled ancillary services. The existing refund rules continue to apply.
